Competences of the Electoral Census Office in European Citizen Initiative

The European Union consolidates the citizenship of the Union and provides for all citizens being entitled to involvement in the democratic life of the Union by means of a European citizen initiative, regarding issues that citizens consider to require a Union legislative act.

General information

The citizen initiatives must fulfil the conditions provided for in Regulation (EU) 211/2011, of the European Parliament and Council, of 16 February, regarding the citizen initiative, applicable from 1 April 2012.

In order to embark on a citizen initiative, a citizen Committee is needed. The Organisers, made up of at least seven citizens of the Union, old enough to vote for the European Parliament and resident in, at least, seven of the Member states.

The Committee is responsible for preparing the citizen initiative, for its presentation in the Commission and for handling the initiative throughout the whose procedure.

The Committee is also responsible for data processing, and therefore for applying the technical specifications for guaranteeing personal data protection when being processed by computer.

In order to ensure coherence and transparency in relation to the proposed citizen initiatives and avoid collecting signatures supporting a proposal that does not comply with the conditions provided for in Regulation (EU) 211/2011, it is compulsory to register such initiatives on a website provided by the Commission, before starting to collect the necessary statements of support from citizens.

In order to support an initiative, the signatories must be citizens of the Union and be old enough to vote in elections to the European Parliament.

A million signatures are needed, from at least a quarter of Member states.

The minimum number of signatories required in each Member state corresponds to the number of Members of the European Parliament, elected in that State multiplied by 750, in Spain 40,500.

Signatures must be collected after registering the initiative at the Commission, within a maximum of 12 months.

The Organisers may gather statements of support on paper or electronically.

In cases whereby statements of support are collected via a website, the data obtained is stored in the territory of a Member state.

The collection via a website system requires certification by the competent authority of each Member state where the data is stored, within one month from the date of application by the Organisers.

The Organisers must present the statements of support collected to the competent national authority for checking and certification of valid ones, differentiating between those collected on paper, signed electronically or online without an electronic signature. Certification must be issued within 3 months of its delivery.

Competences of the ECO

1. The Electoral Census Office has been designated by Spain as the certification authority for electronic collection systems via websites.

Certifications of electronic collection systems in Spain will be performed pursuant to Executional regulation (EU) 1179/2011 of the Commission, of 17 November 2011, whereby technical specifications for collection systems via websites are established.

The accreditation application for a citizen initiative of the collection website system where the latter is hosted in Spain, will be performed supplying the technical documentation that demonstrates compliance by said system with all the security requirements set out in Regulation (EU) 211/2011 and in Executional regulation (EU) 1179/2011, according to the Auditing requirements

The part relating to the information security management system will be regarded as carried out if the collection system is hosted in an ISO 27001 certified physical and logical infrastructure.

The part relating to functionalities of the computer application will be regarded as carried out if Commission software is used.

2. The Electoral Census Office has been designated as the checking and certification authority for statements of support of Spain.

Details of support declarations are different depending on the Member state, pursuant to annex III of Regulation (EU) 211/2011, as amended by COMMISSION DELEGATED REGULATION (EU) No 2015/1070, of 31 March 2015, that modifies.

A) Countries with the form model set out in PART A of Annex III, not including the personal identifier of the signatory, among which Spain is not included. In them, certifications may be performed for their residents or nationals, according to the relation of ANNEX III, PART C, point 1.

B) Countries with the form model provided for in PART B of the Annex III, including the personal identifier of the signatory, among them Spain. In them, the certifications will be performed only from the statements by their nationals, who provide a personal identification number issued by the Member state, according to the relation of the ANNEX III, PART C, point 2.

Therefore:

1) The statements of support by a Spaniard resident in Spain including the Spanish personal identifier (ID card or Passport) will be checked in Spain.

2) The statements of support by a Spaniard resident abroad will be checked in the following manner:

2.1) The statements collected with the form model set out in PART A of Annex III   will not be checked in Spain. However, they may be checked in the Country of residence, depending on its requirements.

2.2) The statements collected with the form model provided for in PART B of the Annex III including the Spanish personal identifier (ID card or Passport) will be checked in Spain.

3) Statements of support by nationals of other Member States of the EU resident in Spain collected with the form model provided for in PART B of the Annex III including the Foreign National Identification Number (NIE), from the card or the certificate, corresponding to the registration at the Central Register of Foreign Nationals, will be checked in Spain.
